The buyer`s early ownership should be settled with a written lease separate from the sales contract and in addition to the sale agreement. Owning a home usually transfers from the seller to the buyer at the time of closing, but sometimes a buyer will ask the seller to grant early ownership before closing. Buyers usually apply because their rental is finished or their old home has already been sold, and they need a place to live immediately. Buyers should agree in writing that they will not modify the house without the owner`s consent, or that they will have to pay to return the house to its former condition if the closure does not take place. HOLDING OVER – If, for any reason, the offer to purchase is terminated by a party, it should be considered that the buyer is required to evacuate the property at the end of the life. If, subsequently, the buyer remains in the property (holding over), such holding over is considered a breach of contract and the day-to-day and eventual legal costs can worsen rapidly. The wording should contain details of what will happen if the sale is not completed on time – or if it is never closed. Determine how long buyers have to evacuate, and define what happens if they don`t. Sellers make the final decision as to whether early possession is useful for their transaction, but most listing agents advise 20s because too many things can go wrong. In the first scenario, the buyers gave the sellers $10,000 to move in early because they had to move out of the current house. Once the buyers were taken into possession, they decided not to close.
