The Australian Skills Quality Authority (ASQA) is responsible for regulating work placements organised by training organisations (NGOs) registered in Queensland. If the internship does not meet all the above criteria, it is not a professional internship under the FW Act. However, this does not automatically mean that the person is an employee and has the right to pay. The next step is to determine whether the person is in an employment relationship or not. Under the FW Act, a professional internship is legally unpaid if it meets all of the following criteria: if the company decides to have Jayne sign an employment contract and pay her salary for her work, she can turn the internship into an employment relationship. In the event of an employment relationship, Jayne is entitled to at least the legal minimum wage for the type of work she performs. NGOs must continue to comply with the standards applicable to training organisations registered with the NVR when they have students on a professional internship. At the bottom of each course information page, you will find a section called Important Information. Please read them carefully before applying to ensure that you understand all the requirements before and during your studies. Important information describes any previous experience or knowledge you may need, as well as resources you need, registrations you may have or need to complete, and details about internships or professional internships.
You must take into account insurance, workcovers and employment relationship agreements regarding the student`s internship. Contact ASQA for more information on the professional internship regime. Mitchell chose his subjects to study the following year as part of his bachelor`s degree. One of the subjects to choose is a 3-month unpaid internship organized by the university in a host company and offering a structured experience related to his degree. This placement is considered a credit for the fulfilling of all his course request. As the optional subject is part of his studies, Mitchell`s internship meets the definition of a professional internship under the FW Act. As this regulation complies with the definition of a professional internship under the FW law, it can be unpaid. Jayne is in her final year of mechanical engineering studies and has completed her formal studies. .
