Landlords may have a legitimate right to the tenant`s deposit, especially if the tenant left without the landlord`s consent and did not have a break-up clause. While deposit companies such as TDS can decide whether a tenant disagrees with the landlord`s decision to keep a deposit, they cannot deal with counter-claims. So if a tenant left prematurely because they think the landlord is violating the agreement, the tenant should instead try to get his deposit back through the court of claim. If you wish to terminate your contract prematurely without any of the reasons mentioned by law, you should keep in mind that even if a tenant follows this procedure, the landlord may attempt to sue the tenant on a rent due until the end of the lease. However, if this is the case, the tenant can prove that the lessor was informed of the problems, had sufficient opportunities to resolve them and was aware of the potential impact of the lack of response to the tenant`s requests. You can find your landlord`s address in your rental agreement or in your rental book. Ask your landlord if you can`t find them – they have to give you the information. It would be quite unusual for a landlord to simply accept a tenant who terminates a 6-month contract after a few days. However, you said that the owner agreed that your partner had moved. If he has agreed to the end of the lease, your partner may have been exempted from his obligation to pay the rent for the full term.
It does not seem that this is what the landlord thinks happened if he now follows the rent. If the landlord has not released your partner from his obligation by accepting the rent rebate, your partner is responsible for paying the rent for the entire rent of 6 months. Looks like the landlord is willing to help by trying to find a new tenant, then frees your partner from any subsequent liability. Many landlords, including me, will try to help tenants who want to go, but there is no obligation to do so, and few will accept that they are out of their pocket because they have a rent gap.
